The terms on which Capasight for Azure DevOps — the Azure DevOps extension published on the Visual Studio Marketplace — is licensed. This agreement applies to that extension only. Capasight:Lite for Jira is licensed through the Atlassian Marketplace, on the terms shown on its listing there.

1. Who this agreement is between
This agreement is between Agile Project Management Services Limited, trading as Capasight (“we”, “us”), and the organisation that installs Capasight for Azure DevOps (the “extension”) into an Azure DevOps organisation (“you”). Installing or using the extension means you accept it. If you do not accept it, do not install or use the extension.
2. The licence
We grant you a non-exclusive, non-transferable licence to use the extension in the Azure DevOps organisations it is installed in, for your internal business purposes, for as long as this agreement lasts. We keep all rights in the extension that this agreement does not expressly give you.
3. The trial, and licences
Every Azure DevOps organisation may use the extension free of charge for 30 days from the day anyone in it first uses the extension. After that, continuing to use it needs a licence key from us, bound to that organisation: free for organisations of up to 10 users, and otherwise a paid licence for a term of one year, at the prices on the listing at the time of the order, invoiced by us and payable by bank transfer. A licence covers up to the number of users it states, and keeps working for 14 days after its term ends while it is renewed. Microsoft does not sell or bill for Azure DevOps extensions, so every licence is bought from us directly, not through Microsoft, using our order form.
4. Your data
Your data remains yours. The extension runs in your users’ browsers inside Azure DevOps, reads Azure DevOps with each user’s own permissions, and keeps what it stores in your Azure DevOps organisation. We receive none of your work data. How it is handled is described in our privacy policy.
5. What you may not do
You may not sell, resell, rent, sublicense or distribute the extension; copy or modify it other than as the Visual Studio Marketplace and Azure DevOps do in installing and running it; or reverse engineer it, except to the extent the law allows despite this restriction.
6. Support and changes
Support is by email to contact@capasight.co.uk, as described on our Resources page. We may update the extension from time to time; Azure DevOps installs updates automatically.
7. No warranty
The extension is provided “as is”, without warranties of any kind, to the extent the law allows. The figures it shows are planning aids built from your own Azure DevOps data; decisions made with them remain yours.
8. Liability
To the extent the law allows, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, data or goodwill, and our total liability under this agreement is limited to the fees you paid us for the extension in the twelve months before the claim. Nothing in this agreement limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
9. Ending this agreement
You may end this agreement at any time by uninstalling the extension. We may end it if you materially breach it and do not put the breach right within 30 days of being told about it. When it ends, you must stop using the extension.
10. Law
This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
